These terms govern your use of Our Memory Book ("the Service"), a service of Mostest Venture, LLC ("the Company," "we," "us," or "our"), operated at ourmemorybook.com. By creating an account or submitting content, you agree to these terms.

1. Accounts

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use the Service.
• One person or entity per account. Accounts are not transferable.

2. Your Content

You retain ownership of all content you submit ("Your Content"), including memories, photos, and other media. By submitting content, you grant us a limited license to:

• Store, display, and deliver Your Content to authorized viewers of the book
• Process media files (resize images, scan for malicious content)
• Include Your Content in data exports requested by the book owner

This license ends when Your Content is deleted from the Service.

3. Contributor Content

As a book owner, you may receive submissions from contributors via web form, email, SMS, WhatsApp, or Telegram. You are responsible for:

• Moderating submissions to your books
• Respecting contributors' privacy preferences (public vs. private submissions)
• Responding to contributor requests to modify or delete their submissions
• Ensuring your book's use complies with these terms

4. Acceptable Use

You agree not to use the Service to:

• Submit content that is illegal, threatening, harassing, defamatory, or obscene
• Impersonate another person or misrepresent your identity
• Upload malware, viruses, or malicious files
• Attempt to gain unauthorized access to other accounts or systems
• Send spam or unsolicited messages through the channel submission features
• Circumvent rate limits, captcha protections, or other security measures
• Use the Service for commercial advertising or solicitation
• Scrape, crawl, or automated-harvest content from the Service

5. Channel Submissions (SMS, Email, WhatsApp, Telegram)

When submitting memories via messaging channels:

• SMS and WhatsApp: Standard carrier messaging and data rates apply. Message frequency depends on your interaction. Reply STOP to the Service phone number to opt out of confirmation messages.
• Email: Submitting a memory by email constitutes consent to receive a single confirmation reply.
• Telegram: You can stop interacting with our bot at any time by blocking it.

We are not responsible for charges from your carrier or messaging provider.

6. Moderation and Content Removal

Book owners control moderation of their books. We reserve the right to remove content or suspend accounts that violate these terms, without prior notice. We are not obligated to monitor all content but may do so at our discretion.

7. Subscriptions and Payment

• Some features require a paid plan (Starter or Pro).
• Payments are processed securely by Stripe. We do not store payment card details.
• Plan features and pricing may change. Existing subscribers will be notified of material changes.
• You may cancel your subscription at any time from your account settings. Access to paid features continues until the end of the current billing period.
• Refunds are handled on a case-by-case basis. Contact us to discuss.

8. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from Service downtime.

9. Intellectual Property

The Service itself — including its design, code, branding, and documentation — is the property of Mostest Venture, LLC. You may not copy, modify, or redistribute any part of the Service. Your Content remains yours as described in Section 2.

10. Termination

• By you: You may delete your account at any time from your account settings. This permanently deletes all your data, books, and submissions.
• By us: We may suspend or terminate accounts that violate these terms or engage in abusive behavior. We will attempt to notify you by email before permanent termination, except in cases of severe violations.

11. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
• Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.
• We are not responsible for content submitted by third-party contributors to your books.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

13. Disputes

These terms are governed by the laws of the United States. Any disputes will be resolved through good-faith negotiation first. If unresolved, disputes will be subject to binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.

14. Changes to These Terms

We may update these terms from time to time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance of the updated terms.
